Yes Mother's terms and conditions

Below you'll find our terms and conditions. We recommend reading through them carefully before placing an order to be fully informed of your rights and obligations. By placing an order, you agree to these terms.

General

1.1 These terms and conditions apply to all offers made by Yes Mother. The terms are accessible to everyone and are included on the Yes Mother website. Upon request, we can send you a written copy.

1.2 By placing an order, you indicate that you agree with the delivery and payment conditions. Yes Mother reserves the right to amend its delivery and/or payment conditions after the expiry of the validity period.

1.3 Yes Mother guarantees that the delivered product meets the agreement and complies with the specifications listed in the offer.

Delivery

2.1 Delivery is subject to availability.

2.2 The delivery time is usually 5-7 working days (excluding pre-orders). Yes Mother will agree to a delivery period of no more than 30 days. If the agreed delivery time is exceeded for any reason, the buyer has the right to dissolve the agreement, and any payments made will be refunded within 14 days.

2.3 All timeframes mentioned on the website are indicative. No rights can be derived from these mentioned timeframes.

Prices

3.1 Prices will not be increased during the validity period of the offer unless legal measures make this necessary or the manufacturer implements interim price increases.

3.2 All prices on the website are subject to printing and typographical errors. No liability is accepted for the consequences of such errors.

3.3 All prices on the website are in EUROS and include either 9% or 21% VAT.

Reflection period/Right of withdrawal

4.1 In the case of a consumer purchase, in accordance with the Distance Selling Act (Article 7:5 BW), the buyer has the right to return (part of) the goods delivered within 14 working days without giving any reason. This period begins when the ordered items are delivered. If the buyer has not returned the goods to Yes Mother after the expiry of this period, the purchase becomes final.

4.2 Before returning any items, the buyer must notify Yes Mother in writing within 14 working days of delivery. The buyer must prove that the items were returned on time, for example, by providing proof of postal delivery. Returns must be made in the original packaging (including accessories and accompanying documentation) and in new condition.

4.3 If the sealing sticker has been broken or if the items have been used, encumbered, or damaged in any way, the right to withdraw, as mentioned in this clause, expires. With due regard to the preceding, Yes Mother will ensure that the full purchase price is refunded to the buyer within 30 days after receiving the returned goods. The cost of returning the goods is entirely borne by the buyer.

Data management

5.1 If you place an order with Yes Mother, your details will be included in Yes Mother's customer database. Yes Mother complies with the Personal Data Protection Act and will not provide your information to third parties.

5.2 Yes Mother respects the privacy of users of its website and ensures confidential treatment of your personal information.

Warranty

6.1 Yes Mother guarantees that the products it supplies meet the requirements of usability, reliability, and lifespan as intended by the parties in the purchase agreement and thus stands behind the manufacturer's warranty for the product delivered to you.

Quotations

7.1 Quotations are non-binding unless otherwise stated in the quotation.

7.2 Upon acceptance of a non-binding offer by the buyer, Yes Mother reserves the right to withdraw the offer or deviate from it within 3 working days of receipt of acceptance.

7.3 Verbal promises only bind Yes Mother once they have been explicitly confirmed in writing.

Agreement

8.1 An agreement between Yes Mother and a customer is established once an order has been assessed for feasibility by Yes Mother.

8.2 Yes Mother reserves the right, without giving reasons, to refuse orders or to accept them only under the condition of cash on delivery or prepayment.

Images and specifications

9.1 All images, photos, drawings, etc.; including information on weights, dimensions, colours, images of labels, etc., on Yes Mother's websites are approximate, indicative, and cannot give rise to any compensation or dissolution of the agreement.

Force majeure

10.1 Yes Mother is not liable if and insofar as its obligations cannot be fulfilled due to force majeure.

10.2 Force majeure includes any external cause as well as any circumstance that reasonably should not be at Yes Mother's risk. This includes delays or failure to perform by our suppliers, transportation difficulties, strikes, government measures, delays in supply, negligence by Yes Mother's suppliers and/or manufacturers, as well as auxiliary staff, staff illness, defects in auxiliary or transport means, all of which explicitly count as force majeure.

10.3 In the event of force majeure, Yes Mother reserves the right to suspend its obligations and is also entitled to dissolve the agreement in whole or in part or to demand that the content of the agreement be modified so that execution remains possible. In no case shall Yes Mother be obliged to pay any penalty or compensation.

Applicable law/Jurisdiction

11.1 All agreements are subject to Dutch law.

11.2 Any disputes arising from an agreement between Yes Mother and the buyer that cannot be resolved by mutual agreement will be submitted to the competent court within the Amsterdam district, unless Yes Mother prefers to submit the dispute to the competent court of the buyer's place of residence, except for disputes falling under the jurisdiction of the subdistrict court.
